Gift Card promotion for new subscribers to the newsletter
BEFORE PARTICIPATING IN THE ABOVE PROMOTION, YOU MUST READ THESE TERMS AND CONDITIONS. BY PARTICIPATING, YOU ACCEPT THAT YOU ARE BOUND BY THE TERMS AND CONDITIONS.
Terms and Conditions: By participating in the Gift Card promotion ("Promotion"), these Terms and Conditions shall be deemed to be a legally binding agreement between you and the Promoter (as defined below). In particular, by participating in the Promotion, you agree that the Promoter may use the personal information provided by you for the purpose of sending the newsletter and web emails, which is free of charge and is governed solely by these Terms and Conditions.
Organizer: The organizer of the campaign is Designer Outlet Berlin (OMF German Services GmbH, Alter Spandauer Weg 1 in 14641 Wustermark; Imprint: https://www.mcarthurglen.com/de/outlets/de/designer-outlet-berlin/kontakt/).
Promotion Period: The promotion period is valid from 00:00 CET on 4th March 2024 until 19:30 CET on 8th March 2024. The Gift Cards will be handed over exclusively at the organizer's "Guest Service" on March 8, 2024.
Eligibility: Entrants must be an individual and must subscribe to the Promoter's newsletter during the Promotion Period and register as a new customer of the McArthurGlen Club (separate terms and conditions apply). Sweepstakes clubs and automated services are not eligible. The following are also not eligible to participate:
(a) employees or immediate family members of an employee of the Promoter or its promotional partners, their affiliates, agents, affiliates or subsidiaries, and any person otherwise associated with the administration of the Promotion.
(b) Persons who have been members of the McArthurGlen Club in the past 24 months and/or have been subscribers to the newsletter during the said period.
In addition, the Promoter reserves the right, at its sole discretion, to exclude any person from participation if there are legitimate reasons, such as (i) in the event of manipulation in connection with access to or operation of the Promotion, (ii) in the event of breaches of these Terms and Conditions, (iii) in the event of unfair conduct or (iv) in the event of false or misleading information in connection with participation in the Promotion.
Majority: By participating in the Promotion, you confirm that you are either (a) 18 years of age or older, or (b) a minor and have obtained consent from a parent or guardian to participate in the Contest.
Participation: Participation is free of charge.
Prize: A total of 150 shopping vouchers (MCArthurGlen Gift Card) for the Designer Outlet Berlin worth €5 each. Each voucher cannot be combined with other promotions and/or discounts of the Promoter, in particular a shopping voucher is not valid for already discounted items as well as special promotions and offers. The vouchers can only be redeemed in participating shops of the Promoter; an up-to-date list of participating shops can be found on the homepage of the organizer unterhttps://www.mcarthurglen.com/de/outlets/de/designer-outlet-berlin.
The shopping vouchers can only be picked up in person at the organizer’s “Guest Service” on March 8, 2024. There is no right to delivery. Shopping vouchers that are not collected on the aforementioned day expire and can no longer be used.
The shopping vouchers will be awarded to the first 150 eligible participants in the order in which they are picked up at the organizer's “Guest Service”.
When accepting the shopping voucher, valid proof of identity (ID card or passport) and the welcome email must be presented.
Taxes: the Promoter is responsible for reporting and paying all taxes, fees and other charges, insurance premiums and handling fees and any other costs incurred in order to redeem a prize.
Disclaimer: the Promoter makes no warranties and makes no representations of any kind in relation to the Promotion, any prize or the (ability to) participate in the Promotion, except as expressly set out in these T&Cs. The Promoter excludes any liability for participation in the Promotion and therefore is not liable for any damage or other disadvantage resulting from participation or winning or using any prize. This does not apply to damage to life, body and health as well as to damages based on intentional or grossly negligent injuries of the organizer, its prize sponsors or its dealers as well as its legal representatives or vicarious agents, as well as not to liability under the Product Liability Act.
Abandonment of any legal claims: by participating in the Promotion, you agree to indemnify and hold harmless the Promoter, its prize sponsors, McArthurGlen Designer Outlets dealers and their respective affiliates and employees from and against any and all claims of any kind arising directly or indirectly from (a) participation in the Promotion (b) receipt, the use or misuse of the Prize (c) typographical errors, typographical errors or other errors in any materials involved in the Promotion, the announcement of the prize or in any other announcements and (d) any other errors in the Promotion. This does not apply to damage to life, body and health as well as to damages based on intentional or grossly negligent injuries of the organizer, its prize sponsors or its dealers as well as its legal representatives or vicarious agents, as well as not to liability under the Product Liability Act.
Trademarks: all displayed trademarks, copyrights and other images are the property of the Promoter or its licensors and are used under a written or implied license. The use of third party materials (including such trademarks) does not imply any business relationship between such third parties and the Promoter or vice versa.
Changes: The Promoter reserves the right, at its sole discretion and without prior notice, to suspend or cancel the Promotion or to amend the Terms and Conditions at its sole discretion in the following situations: (a) in the event of an accident, (b) if a typographical error, administrative or other error has occurred, (c) if this is necessary for the proper operation of the Promotion. (d) if at any time there are indications of manipulation or other unforeseeable events that could affect the correct performance of the Promotion. General Provisions: Failure to comply with these terms and conditions may result in exclusion from the Promotion (at the Promoter's sole discretion). The promotion and the terms and conditions of participation are governed by German law. The Promoter is under no obligation to disclose any information relating to the Promotion, including the number of entry forms received, the number of valid entry forms or other figures relating to the Promotion, except as required by law or expressly set out in the Terms and Conditions. The Promoter shall not be liable to anyone (including entrants) for any delay or failure in the execution of the Promotion caused by circumstances beyond the Promoter's control, including (without limitation) internet performance problems, loss or incorrect delivery of information (including in entry forms), Failures or cases of force majeure. The Promoter reserves the right to exclude individual participants from the promotion if there is reason to suspect that the terms and conditions have been violated or that the promotion has been manipulated by that participant. Disputes concerning the Promotion will be decided at the sole discretion of the Promoter, which decision will be final and binding. Legal recourse is excluded.
Should any provision of these Terms and Conditions of Participation be or become void, invalid or unenforceable in whole or in part, this shall not affect the validity of these Terms and Conditions of Participation in all other respects. Instead of the void, invalid or unenforceable provision, the legally permissible provision that comes as close as possible to the meaning and purpose expressed in the void, invalid or unenforceable provision shall apply. The same applies in the event of a loophole in these Terms and Conditions of Participation.
Personal Data: by participating in the Promotion, each participant gives his/her consent to the processing of his/her personal data solely in relation to the Promotion, in accordance with the Promoter's privacy policy. In order to participate, it is necessary to provide personal data. The participant assures that the personal information provided by him/her, in particular his/her first name, surname and e-mail address, is truthful and correct. The processing of the personal data collected in the context of the campaign is carried out and processed on the basis of Art. 6 para. 1 sentence 1 lit. b GDPR.
The organizer points out that all personal data of the participant will not be passed on to third parties or made available to them for use without consent.
