TERMS OF PARTICIPATION
These terms of participation relate to the Advent Calendar Promotion taking place from 1 December 2024 until 24 December 2024, during which participants have a daily chance to win a prize (hereinafter the "Promotion").
The Promotion is an initiative of Outlet Rosada BV, a company incorporated under the laws of the Netherlands, registered with the Chamber of Commerce under no. 67089194, having its registered office and principal place of business at Stadsweide 2, 6041 TD Roermond, hereinafter ‘DOC'.
Article 1 Eligibility
1.1.: The Promotion is open to participants who are 18 years of age or older at the time of entry.
1.2.: Employees of DOC or any affiliate, subsidiary, and advertising and promotion agency and their and their immediate family members are excluded from participation.
Article 2 How to Enter
2.1.: For the duration of the Promotion, a new prize shall be announced on the official Instagram account of DOC (@designeroutletroosendaal) daily. To validly participate in the Promotion and to be eligible for a specific prize that is part of the Promotion, participants must (a) 'like' (click the 'like button') of the Instagram post regarding that specific prize and (b) place a comment (following the instructions included in that specific post) under the Instagram post. Participants must take both aforementioned steps within 72 hours after the publication of the Instagram post related to that specific prize.
2.2.:Only one entry per participant per prize is allowed. Multiple entries by the same account will be disregarded.
2.3.: Participants are not allowed to use more than one Instagram account to participate for the same prize. Participants that take part using multiple Instagram accounts will be disqualified.
2.4.: Participation is free or charge.
Article 3 Prizes
3.1.: The prizes included in the Promotion vary and can be of different nature, e.g. they can be either items or gift sets of our DOC store's brands or coupons for a dinner in one of the DOC restaurants or at one of our partners.
3.2.: The announcements of the various prizes as referred to in article 2.1, shall mention the prize in question and the value of that specific prize.
3.3.: The prizes included in the Promotion are not transferable or exchangeable for cash or other alternatives.
3.4.: The prize won is not exchangeable with other prizes included in the Promotion.
3.5.: In the event that tax on games of chance is due in relation to the Promotion, DOC will declare this tax to the tax authority. The tax will not be deducted from the (value of the) prize of the winner.
Article 4 Winner and Notification and Prize Collection
4.1.: For each individual prize awarded during the Promotion, the winner will be selected at random on Instagram from all eligible entries received, using a digital comment picker tool.
4.2.: Winners will be notified via a direct message on Instagram, by 13 January 2025 at the latest.
4.3.: Winners will be invited to contact DOC through the indicated contact details to make arrangements to collect the prize at DOC's guest Services Point, unless otherwise communicated by DOC.
4.4.: If a winner explicitly waives his/her right to receive the prize, DOC is entitled to withdraw the prize for the initial winner and select a replacement winner.
4.5.: If a winner cannot be contacted or does not claim the prize within 14 days after the notification as referred to in article 4.2, DOC reserves the right to withdraw the prize and either sell it and keep the proceeds, or to give the prize to a third party or charity.
4.6.: Participants shall collect the prizes ultimately on 31 January 2025.
4.7.: DOC is entitled to demand identification of a participant at the moment of collection. Refusal to provide appropriate means of identification will lead to exclusion from the contest.

Article 5 General Conditions
5.1.: DOC reserves the right to cancel, terminate, modify, or suspend the Promotion in the event of any unforeseen circumstances beyond its control.
5.2.: By participating, participants agree to be bound by these terms of participation and the decisions of DOC, which are final and binding in all respects.
5.3.: For the purpose of the Promotion, communicating with and about the winning participants as well as inviting winning participants to collect their prize DOC will process personal data of the participants. Winning participants consent to DOC making their name public and sharing their Instagram handle. 5.4.: DOC reserves the right to exclude from the Promotion participants it considers to be abusing the Promotion, either by not fulfilling these terms of participation, acting fraudulently or influencing or trying to influence the outcome of the Promotion in undue ways.
5.6.: DOC reserves the right to exclude from the Promotion participants it considers to be sending in comments containing lewd, offensive, sexually explicit, offensive or discriminating language or image(s), or any other profanity, obscenity or illegal elements.
5.7.: Complaints regarding the Promotion, can be submitted in writing to marketing.nl@mcarthurglen.com. DOC will assess eventual complaints and revert to the complainant within 14 days of receipt of the complaint. If the complaint is not resolved to the complainant's satisfaction, the complainant shall have the right to file a complaint with the Dutch Gaming Authority.

5.9.: Participants indemnify and hold harmless Instagram for any dispute or matter arising out of or in connection with the Promotion.

6.1.: DOC is not responsible for any incorrect or inaccurate information, technical failures, or unauthorized human intervention in the Promotion.

6.2.: By accepting the prize, the winner agrees to release and hold harmless DOC and its affiliates from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Promotion or the use of the prize.
Article 7 Governing law
7.1.: The Promotion and these terms of participation are governed by, and the provisions thereof will be construed in accordance with the laws of the Netherlands.
7.2.: Any dispute or matter arising out of or in connection with this Promotion or these terms of participation will be subject to the exclusive jurisdiction of the Limburg District Court, location Roermond, the Netherlands.
