Terms & Conditions

The MOVE YOUR MIND is an initiative of ASICS in collaboration with McArthurGlen Designer Outlet Málaga to promote the ASICS brand. Hereinafter, McArthurGlen Designer Outlet Málaga and ASICS will be jointly referred to as the “Parties”.

Promotion is governed by these general terms and conditions.

Duration and entry

The promotion will start on Saturday, May 21st 2022.

Gadgets

The approximate retail value of the gadgets is €25 and consists of:
- ASICS bag
-ASICS t-shirt.
-ASICS discount leaflets.
- Piece of fruit.
- Bottle of water. 

Costs of the gadgets will be covered by ASICS and McArthurGlen.

All other expenses are not covered.  

The MOVE YOUR MIND will take place in McArthurGlen Designer Outlet Málaga main square.

Accommodation, food, drinks, any and all travel expenses, loss or theft of property, travel documents required, will not be covered by McArthurGlen or ASICS.

1.3. HOW TO PARTICIPATE

Participation in the activity is free of any charge and is open from 21st May 2022.

Subscription Period. All entries received outside of the Event Period (before 21st May 2022 and after 2nd June 2022) and those that do not comply with these T&Cs are automatically disqualified.

In order to participate in the event, participants must subscribe to the MOVE YOUR MIND event in the dedicated website registration form.

Entrance and participation in the Event are subject to the acceptance of these general terms and conditions and personal data of the recipients will be processed in accordance with ASICS privacy policy.

 

GENERAL TERMS AND CONDITIONS

  1. ELIGIBILITY

1.1. Legal residents of the participating countries who have reached the age of 18 y.o. are eligible to participate in the Event. The Event is for private purposes only. Directors, officers, management, employees, other staff and the immediate family and household members of those individuals of ASICS, ASICS offices in the participant countries, sales force, and ASICS retailers (including their staff), agencies involved in the development of this Event, affiliated companies and other persons involved in the Promotion are not eligible to enter this Event.

1.2. In order to be eligible to participate in the Event and to receive the gadgets, the recipient must fully comply with these general terms and conditions, and by accepting the gadget the recipient agrees to be bound by these general terms and conditions and the decisions of ASICS, whose decisions shall be binding and final in all respects.

  1. GADGETS DETAILS AND CONDITIONS

3.1. The approximate retail value of the gadgets is €25. The gadget is subject to any and all applicable terms and conditions of ASICS. Any depictions of gadgets are for illustrative purposes only. No transfer, refund, substitution or replacement of the gadget is permitted.

3.2. Entry to participation is free, No costs necessary for entry

3.3. Subject to change, the Event will take place on 4&5 June 2022. There will be one session each day at 10.30am.

3.4. The will not be a winner in the Event.

 

 PERSONAL DATA

4.1 Any processing of personal data provided by recipients in connection with participation in the Event will be used for administration of the Event only and is subject to McArthurGlen Privacy Policy.

 

4.2. By participating in the event, the participant agrees to be filmed / photographed during the event

 

  1. LIABILITY WAIVER

5.1 None of the Parties, nor their subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any give away gadgets to a recipient, with regards to:

(a) gadget claims that contain inaccurate information or do not comply with or violate the general terms and conditions;

(b) gadget claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind;

(c) recipients who have committed fraud or deception in entering or participating in the Event or claiming the gadget;

(d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties;

(e) any inability of the recipient to accept the gadget for any reason;

(f) if a gadget cannot be awarded due to travel cancellation, delays or interruptions due to Acts of God, natural disasters, terrorism, pandemic, weather or any other similar event beyond ASICS’s reasonable control; or
(g) any damages, injuries or losses of any kind caused by the making of the video, the prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any gadget or resulting from participating in this event or any promotion or prize related activities.

5.2 The recipient, by claiming and/or accepting the gadget, agrees to release and hold harmless both Parties and their subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury (including emotional distress), illness, health issue, and/or death which may occur in connection with preparation for, or participation in, the Event, or possession, acceptance and/or use or misuse of the gadget or participation in any Promotion-related activity and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery. Insofar as is permitted by the law, Both Parties (including its officers, employees and agents) exclude all liability (including negligence) for any personal injury or any loss or damage otherwise arising out of or in connection, directly or indirectly, with the Promotion.

5.3 None of the Parties, nor their subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors assume no responsibility for any injury or damage to entrants or to any other person’s computer, regardless of how caused, relating to or resulting from entering or downloading materials or software in connection with this Promotion.

5.4 None of the Parties, nor their subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors assume no responsibility for any loss, theft or damage to participants or companion’s personal belongings carried to and from or bought during the event.

  1. MISCELLANEOUS

6.1. ASICS reserves the right, in its sole discretion, to disqualify any individual/recipient it finds to be:

(a) tampering with the selection process or the operation of the Event, or with any web sites promoting the Event;

(b) acting in violation of the general terms and conditions; or

(c) entering or attempting to enter the Event multiple times through the use of multiple e-mail addresses or the use of any robotic or automated devices to submit claims.

6.2. If ASICS determines, in its sole discretion, that technical or unforeseen events compromise the integrity or viability of the event, ASICS reserves the right to void the claims at gadget at issue, and/or terminate the relevant portion of the Event, including the entire Event’ with a prior notice to MacArthur Designer Outlet Málaga with a minimum notice of [seventy-two (72) hours]. If the Event is terminated or modified due to technical difficulties or unforeseen events prior to the expiration date of the Event Period, notice will be posted at on https://www.mcarthurglen.com/outlets/en/es/designer-outlet-malaga/event-registration/.

  1. JURISDICTION AND DISPUTE SETTLEMENT

7.1. Any claims or complaints regarding this Event should be communicated via email to info.malaga@mcarthurglen.com. Please clearly state your personal details (name and surname) and contact details, the name of the event campaign and the subject of the complaint. McArthurGlen Designer Outlet Málaga will contact you.

7.2. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these general terms and conditions, or the rights and obligations of the recipient or ASICS in connection with the Event shall be governed by, and construed in accordance with, the laws of the Spain. In addition, any dispute relating to the Event (including these general terms and conditions) shall be subject to the exclusive jurisdiction of the courts of the Spain.
